Franchise Terms and Conditions

1. Employment Status & Lesson Arrangements

1.1 All Pass Driving Instructors / Trainers are self-employed, and the contract for tuition exists between the instructor and the pupil.
1.2 Lessons will start and finish at the pupil’s agreed pick-up address unless otherwise agreed in advance.
1.3 All matters relating to lesson timing, location, duration or scheduling are to be agreed directly between the instructor and pupil.
1.4 The instructor will endeavour to provide a regular weekly lesson time where possible. However, lessons may occasionally need to change due to unforeseen circumstances.
1.5 Instructors must take all reasonable steps to arrive on time; delays may occur due to traffic or circumstances beyond reasonable control.




2. Lesson Fees & Payments

2.1 Lesson rates and introductory offers are as listed on the Pass Driving School website and will be honoured accordingly.
2.2 Payment for lessons must be made prior to the start of the lesson.
2.3 The first lesson payment is encouraged to be made online via Pass Driving School website through secure Worldpay card payment.
2.4 Pre-purchased vouchers act as prepayment for lessons.
2.5 Following the first lesson, further payments may be made:

  • Directly to the instructor via business bank transfer (where agreed),

  • By card (where the instructor accepts card payments),

  • Cash only in exceptional circumstances.
    2.6 All payments must be recorded on the pupil’s appointment / record / progress card for transparency.
    2.7 Instructors are responsible for maintaining their own independent financial records.




3. Refunds & Liability

3.1 Pass Driving School will not be held liable for any refunds relating to payments made directly to instructors.
3.2 Any disputes regarding payments to instructors remain solely between pupil and instructor.
3.3 Pass Driving School accepts no responsibility for advance payments made to instructors.




4. Cancellations & Lesson Changes

4.1 If either the pupil or instructor wishes to cancel or amend a lesson (including reducing duration), a minimum of 24 hours’ notice must be given.
4.2 Sundays and public holidays are excluded from the notice period.
4.3 Failure to provide sufficient notice will result in the lesson being charged in full.
4.4 Cancellations and lesson amendments must be communicated directly between pupil and instructor.




5. Block Bookings

5.1 Block bookings include a discounted rate.
5.2 Refunds on block bookings are at the instructor’s discretion.
5.3 If a pupil terminates a block booking early, completed lessons will be charged at full standard hourly rates and only remaining balance refunded.
5.4 If a block booking is purchased, started, but not completed within 6 months, and no agreement has been made to delay, no refund will be issued.




6. Driving Tests & Vehicle Use

6.1 Where a pupil already has a driving test booked, the use of the instructor’s vehicle is at the instructor’s discretion.
6.2 Instructors may withdraw vehicle use if the pupil is not test-ready or is unsafe.
6.3 Regular pupils will receive at least 10 working days’ notice of refusal to support their test, allowing test alteration without fee loss.
6.4 Last-minute test pupils are also subject to suitability and safety approval.
6.5 Pass Driving School is not responsible for cancellations due to instructor vehicle breakdown but will endeavour to source an alternative vehicle promptly.




7. Legal & Medical Requirements

7.1 On the first lesson pupils must present a valid driving licence.
7.2 Pupils must declare any medical or neuro-disability that may affect learning or driving ability.
7.3 Pupils must be able to read a vehicle number plate from 20.5 metres (67 feet).
7.4 Pupils must confirm they are not disqualified from driving under any court ruling.




8. Safety, Conduct & Legal Compliance

8.1 Mobile phones must be switched off or silent during lessons.
8.2 It is illegal to use a mobile phone whilst driving or receiving instruction.
8.3 Driving under the influence of alcohol or drugs is illegal. Lessons will be terminated immediately and charged in full if attempted.
8.4 Pupils must treat instructors with respect. Unsafe, abusive or dangerous behaviour may result in termination of lessons.




9. Records & Transparency

9.1 All instructors must provide pupils with a Progress Record & Appointment Card on their first lesson.
9.2 This must be updated after each lesson and retained by the pupil.
9.3 The card records lesson progress, booking history and any payments made as proof of transaction.

10. Complaints

10.1 If a complaint cannot be resolved directly between pupil and instructor, the pupil should contact Pass Driving School on 0800 612 6547.
10.2 All complaints will be handled confidentially within 48 hours.




11. Equality & Professional Standards

11.1 Pass Driving Instructors operate an equal opportunities policy and will not discriminate based on race, colour, creed, gender, or sexual orientation.
11.2 All instructors adhere to the DVSA ADI Code of Practice (17 February 2017).
11.3 Instructors will remain professional at all times and expect mutual respect from pupils.
